Termination and Disability

In Alberta, the Employment Standards Code makes it illegal to terminate an employee while they are on long-term illness leave. Likewise, the Alberta Human Rights Act prohibits any form of discrimination against an employee due to a medical condition or disability, and protects employees from being fired or treated unfairly due to their medical condition or disability.
Employers must make genuine efforts to accommodate your medical condition or disability, such as adjusting your job duties or allowing a gradual return to work plan.
