Termination and Maternity Leave

In Alberta, employees are protected from being terminated or penalized because they are pregnant or taking maternity or parental leave. Under the Employment Standards Code and the Alberta Human Rights Act, employers must allow employees to take unpaid job-protected leave for pregnancy, childbirth, and the care of a new child, and they must reinstate the employee to the same or a comparable position when the leave ends.

If an employee is dismissed before, during, or after maternity leave, and the decision is linked to the leave or pregnancy, it may amount to discrimination or wrongful dismissal.
