Independent and Dependent Contractors

In Alberta, the distinction between an independent contractor and a dependent contractor can have significant legal consequences. Independent contractors generally operate their own businesses, control their work, and are not entitled to notice or severance under employment law. However, if you relied on one company for steady work or income, were economically dependent on the relationship and functioned much like an employee, you may be considered a dependent contractor.
Dependent contractors are entitled to reasonable notice or pay in lieu of notice upon termination, like employees. When a contractor’s role looks and feels like that of an employee, courts may treat them as a dependent contractor instead.
